Your Venn Mediator will hold a free Zoom or telephone consultation with you to explain the process and establish if mediation could help you. If so, how long the mediation would be expected to take and the cost. The cost is split equally between the participants.
It is important that participants come to the mediation with the authority to settle and a willingness to bring the matter to a close on the day. - Documents needed prior to mediation
An Agreement to Mediate outlines the terms and rules of mediation and must be signed before mediation can take place to ensure confidentiality.
A fee schedule will be provided. On receipt of payment you will receive an acceptance email from your chosen Venn Mediator and you will be invited to send a brief written summary of the dispute. - How/where will the mediation take place?
Traditionally, mediations take place in person but can also be conducted via Zoom or by telephone. - On the day of the mediation
The Mediator will greet you and take you to your own private (real or virtual) room, which you can return to at any time during the process. The Agreement to Mediate must be signed and given to the Mediator before the process can begin.
Mediation sessions often begin with a joint meeting where the Mediator will cover the key aspects of mediation, including confidentiality. Each participant will be asked to make a brief opening statement about the issue that has brought them to mediation and what they hope to achieve from the day.
The Mediator may work in joint session and/or in private with each participant. Experience shows that there is most value in a mixture of joint and private sessions.
- Final conclusion of the dispute
Any agreement terms that are reached shall be written down and signed by both participants. This Settlement Agreement is then legally binding and the dispute finally settled.
